Allison Bailey Loses Court Case Against Stonewall

LGB Alliance Founder Allison Bailey has lost a lawsuit she brought against LGBTQ+ charity Stonewall, which she claimed had instructed her employer – Garden Court Chambers to discriminate against her for her "gender critical" views.

Bailey claims that as a result of her involvement with LGB Alliance which many have described as an anti-trans hate group her employer investigated her and deprived her of work, a decision she believes was made as a result of Garden Court Chambers' involvement in Stonewall's Diversity Champions scheme.

Fundraising over £500,000 from 9,000 individual backers, Bailey had built a social media presence off of the back of her lawsuit against Stonewall, which she had hoped to win. In a judgment handed down on July 27, the Employment Tribunal dismissed any claims against Stonewall, finding that it in no way instructed or informed Garden Court Chambers in its treatment of Bailey. It also found that whilst the Chambers did not withhold work from Bailey, it did discriminate against her by publishing that it was investigating her, that her views were protected in law, and that the Chambers should not have made her delete two gender-critical tweets.

Bailey won her claims against Garden Court Chambers and was awarded £22,000 in damages for hurt feelings as a result, and the result reaffirms the recent Maya Forstater tribunal which found that "gender critical" views are a protected belief in UK law, like veganism or creationism.

The court, however, rejected the idea that Garden Court Chambers had a “practice of treating gender critical beliefs as bigoted,” and “concluded there was no evidence whatsoever that Stonewall directed Garden Court’s investigation process.”

Garden Court Chambers has said it will appeal the judgment.
