Biden’s Title IX law expanding protections for LGBTQ+ students is dealt another setback

On Monday, a federal judge temporarily halted the Biden administration’s new Title IX rule, which extends protections for LGBTQ+ students across six additional states, marking another obstacle for a policy that has faced legal challenges from Republican attorneys general.

U.S.A. District Judge Danny C. Reeves described the regulation as “arbitrary in the truest sense of the word” while issuing a preliminary injunction in Kentucky, Indiana, Ohio, Tennessee, Virginia, and West Virginia. This ruling follows another federal judge’s decision to temporarily block the new rule in Idaho, Louisiana, Mississippi, and Montana.

The decision on Monday in Kentucky was praised by the state’s GOP attorney general, Russell Coleman, who argued that the regulation would harm equal opportunities for women, according to ‘NBC News’.

“The judge’s order makes clear that the U.S. Department of Education’s attempt to redefine ‘sex’ to include ‘gender identity’ is unlawful and beyond the agency’s regulatory authority,” Coleman stated.

The two cases are among at least seven supported by more than 20 Republican-led states opposing President Joe Biden’s rule. Scheduled to take effect in August, the policy broadens Title IX civil rights protections to LGBTQ+ students, redefines sexual harassment in schools and colleges, and introduces new safeguards for victims.

In a separate lawsuit, the Education Department on Friday requested that a federal judge in Missouri reject a preliminary injunction against the new rule. This lawsuit was filed last month by the Republican attorneys general from Arkansas, Iowa, Missouri, Nebraska, North Dakota, and South Dakota.

The department argued that blocking the rule “would substantially harm the federal government’s interest in preventing discrimination in federally funded educational programs and activities.”
