Chinese trans man wins landmark unfair dismissal case

A Chinese court has ruled in favour of a trans man who has claimed unfair dismissal after being fired for wearing men’s clothing. Known to the press as Mr C, he was fired a week after starting at a health centre in Guizhou.

The court ordered his employers to pay his salary and a compensation of 1,500 yuan.

Mr C appealed the decision as the courts ruled he was not discriminated against because he was trans.

“I have not received an apology up until now, which actually means that – in law – there is still very little protection in his area,” he told Radio Free Asia.

The court ruled in his favour, awarding him a further 4,000 yuan and stating that: “An individual’s gender identity and gender expression falls within the protection of general personality rights, (everyone) should respect others’ rights to gender identity and expression.”
