EU to remove ‘gay-test’ for refugees

The European Court of Justice (ECJ) has banned psychological tests to determine the sexual orientation of an asylum seeker. This effectively bans the test in all EU states. For refugees seeking asylum because it is dangerous or life-threatening to be gay in their home country they must undergo a series of tests to prove they are gay. The ECJ ruling comes after a Nigerian man failed his asylum application for Hungary. The test asked him to analyse a series of Rorschach ink-blots and draw a picture of a person in the rain.

The tests have been criticised by LGBT+ activists, including the director of the UK Lesbian and Gay Immigration Group. The ECJ has that while “certain forms of expert reports may prove useful,” they ultimately infringed on the individual’s privacy.

This comes on the heels of several alarming reports regarding LGBT+ asylum seekers, including a report that found many refugees from Chechnya were too terrified to disclose their sexuality to immigration officials, risking their deportation. While last month a gay Ugandan woman attempted suicide after failing her asylum application.
