Gay couple files lawsuit after son denied US citizenship

A gay couple in the US has filed a lawsuit this week after one of their twin sons was denied an American citizenship. The couple, Andrew and Elad, one with an American-Canadian citizenship and the other Israeli-born, conceived their twins through IVF with an anonymous egg donor and with both of their sperm. They are each genetically related to one twin, though on the pair’s Canadian birth certificate they are both listed as the father.

This wasn’t a problem until Andrew and Elad decided to move from Toronto to the US where American law dictates that only biological children, proven with a DNA test, can be granted full citizenship. As one of the twins is Canadian born to an Israeli father he is not granted citizenship.

Andrew was given the option of “adopting” his own son to give him a green card. The couple has said this is not enough. “I just can’t stop thinking about how I’m going to explain to (my son) when he’s older that is different than this twin brother,” Andrew said to the press, “His twin brother is American but he’s a green card holder.”

“What we’re trying to do is pursue justice for (our son),” Elad said, “and correct a wrong that the State Department is continuing to pursue that might affect other couples.”
