Niger enacts law criminalising consensual same-sex intimacy

Niger has formally criminalised consensual same-sex intimacy for the first time, deepening a regional pattern of legal persecution of LGBTQ+ people in West Africa.

A new Penal Code adopted under the country’s military authorities is understood to include provisions targeting so‑called “indecent or unnatural acts” and “sexual relations with a person of the same sex”. Reports indicate that the Code also penalises “LGBTQIA+ practices” and participation in organisations “for homosexuals or LGBTQIA+”. Convictions can reportedly lead to prison sentences of up to 20 years, alongside substantial financial penalties.

Human rights advocates say the law weaponises state power against private, consensual relationships and core civil liberties. Téa Braun, Chief Executive of the Human Dignity Trust, stated that Niger’s military leadership is demonstrating clear disregard for fundamental human rights standards and placing an already marginalised population at heightened risk of harassment, violence and state-sanctioned hostility.

The legal changes are believed to have come into force in February 2026 and have already been followed by what sources describe as a “large-scale crackdown” on LGBTQ+ people in the country. Niger now forms part of a growing group of states where same-sex intimacy is a criminal offence, bringing the global total to 66 countries, 33 of them in Africa. Neighbouring francophone states under military rule, including Burkina Faso and Mali, have recently taken similar steps to criminalise homosexuality, adding to concerns about coordinated regression on LGBTQ+ rights in the region.
