Single-sex toilet law raises concern among trans advocates

Under proposed legislation, new public facilities such as restaurants, public toilets, shopping centres, and offices in England will be compelled to install separate male and female toilets, according to the government.

As part of an initiative to “ending the rise” of gender-neutral toilets, the regulation will target new non-residential buildings, stated Equalities Minister Kemi Badenoch.

Concerns were brought to light during a consultation from women, the elderly, and disabled individuals who felt “unfairly disadvantaged” due to the conversion of existing toilets into gender-neutral facilities with shared cubicles and sinks, as per the government's statement.

However, trans rights advocates have argued that gender-neutral toilets help shield trans individuals from discrimination.

Additionally, rights groups have mentioned that trans people, along with others who do not adhere to conventional gender categories, often face difficult situations while using specific gender toilets.

The government is gearing up to introduce this much-discussed bill to Parliament in the forthcoming weeks and, upon approval, aims to enact it by later this year, according to ‘BBC’.

The amendments to building regulations will still permit the establishment of self-contained, universal toilets, either in addition to or instead of gender-specific toilets, depending on spatial availability.

Defined by the government, a universal toilet is a private room equipped with a toilet and sink designed for use by one person at a time.

The shift towards gender-neutral toilets has led to prolonged wait times in shared queues and reduced privacy, according to the government.

“These regulations will instruct organizations to construct both unisex and single-sex toilets, thereby curbing the proliferation of so-called gender-neutral mixed-sex toilet facilities, which compromise the privacy and dignity of both men and women,” stated Equalities Minister Kemi Badenoch.

“Today’s announcement will also enhance facilities for women so that our specific biological, health, and sanitary needs are addressed.”

When questioned on ITV's Good Morning Britain whether the introduction of gender-neutral toilets might influence public support for the Conservative Party after disappointing local election outcomes, Women’s Health Minister Maria Caulfield affirmed, “This is an important issue for women.”

The forthcoming legislation will be applicable not only to new buildings but also to those undergoing significant renovations. There will be exceptions for certain types of buildings like care homes, custody suite cells, and schools.

During a consultation that received 17,000 submissions, 81% supported the concept of separate single-sex toilets, and 82% favoured the provision of universal toilets where space permits.

Sex Matters, an advocacy group dedicated to maintaining “clarity about sex in law, policy, and language,” expressed that many would “breathe a sigh of relief at this welcome return to common sense.”

Maya Forstater, CEO of the group, noted, “Single-sex toilets provide privacy, dignity, and peace of mind to both genders, but they are particularly crucial for women and girls.”

In a statement regarding the government’s plans, Mermaids, a transgender youth support charity, remarked, “To ensure everyone is treated fairly and feels comfortable using public toilet facilities, it's essential not only to have gender-specific options where trans individuals can feel secure but also to have gender-neutral options to accommodate the needs of non-binary individuals.”

Additionally, last week, the government proposed ensuring that patients in England’s hospitals could request treatment in single-sex wards, and for trans people, individual rooms would be provided.

Patients will also be granted the option to choose a caregiver of the same biological sex for any intimate care.
