U.S.A.:Massachusetts Democrats introduce bill to protect trans people from federal investigations

A bill presented in the Massachusetts Senate, U.S.A., this week aims to support healthcare professionals and lawyers working with individuals seeking gender-affirming or reproductive healthcare.

Democratic State Senator Cindy Friedman introduced the bill, highlighting the president’s criticism of healthcare and Republican control over Congress. She described her bill as a component of a broader legislative effort, “Response 2025,” referencing the conservative Project 2025, as reported by NBC 10 Boston, according to ‘LGBTQ Nation’.

In a press release, Friedman stated that the bill will “protect, defend, and lead Massachusetts through oncoming threats from the federal government.” It prohibits state agencies from sharing information with federal or out-of-state investigators aiming to prosecute healthcare providers or lawyers assisting individuals in obtaining gender-affirming or reproductive care.

If enacted, the bill would also prohibit insurance companies from discriminating against nonprofit organisations providing such services to Massachusetts residents. Additionally, it mandates data protection measures for electronic medical records to prevent out-of-state access.

Supporters of the bill said, “Data sharing to the federal government and other entities could put patients and Massachusetts providers at risk—especially those accessing, prescribing, or dispensing medications related to reproductive or gender-affirming care.”

Friedman emphasised, “Gender-affirming care is a legal type of care in Massachusetts.” She added, “This [bill] says, ‘You, as the federal government and other states, cannot determine what is legal health care in Massachusetts. You seem to be so focused on the whole issues around gender, we’re not going to allow that because Massachusetts has decided that this is a legal form of health care.’ They love to talk about gender-affirming care and women’s reproductive health, but we, the state, get to decide what kind of care is legal and can be delivered in Massachusetts.”

While other states like Minnesota, California, Illinois, and Connecticut have enacted laws to become transgender sanctuary states, focusing on protecting transgender rights from other states' law enforcement, the Massachusetts law also prevents state agencies from collaborating with federal law enforcement.

The emergence of sanctuary states counters the current administration’s increasing hostility toward healthcare freedom compared to the previous administration. Earlier this year, the president issued an executive order prohibiting gender-affirming care for transgender youth and young adults.

Friedman’s bill also safeguards emergency abortion access, mandating hospitals provide such services when deemed necessary by healthcare providers.

“They can’t turn anyone away. They have to provide the care that’s going to save your life,” she stated.

Last week, Massachusetts Democratic legislators approved a $1.3 billion (approximately £980 million) budget bill, which included a trans sports ban. The bill required a policy analysis for safety concerns before implementing the ban and necessitated a separate bill for the ban to take effect.

The Republican who proposed the amendment to bar trans students from sports teams aligning with their gender identity expressed anger over Democrats neutralising his amendment. Meanwhile, LGBTQ+ advocates criticised Democrats for supporting any anti-trans policy at all.
