Ukrainian court affirms rights of same-sex couple in landmark decision for LGBTQ+ equality

In a landmark moment for LGBTQ+ rights in Ukraine, a district court has officially recognized a same-sex couple as a family, setting a hopeful precedent for future equality.

The plaintiffs, Zoryan Kis, a respected diplomat serving as the first secretary of Ukraine’s Embassy in Israel, and his dedicated partner, Tymur Levchuk, have shared their lives since 2013 and formalized their union with a marriage in the United States in 2021.

As reported by LGBTQ+ Nation, this decision comes after the Ukrainian Foreign Ministry's regrettable denial of Levchuk's rights as Kis' spouse to accompany him on his diplomatic assignment to Tel Aviv in 2024, prompting the couple to seek legal recourse.

The court based its ruling on the Ukrainian constitution and the established principles of the European Court of Human Rights (ECHR), of which Ukraine is a signatory. The ECHR mandates that member states provide legal recognition and protection to same-sex families. Evidence presented, including shared finances, joint travel records, personal correspondence, and witness testimony, affirmed the enduring and committed nature of their partnership.

"A very big and important step toward marriage equality in Ukraine, and a small victory in our struggle for ‘simple family happiness’ for Ukrainian diplomats," Kis shared on social media following the ruling, expressing gratitude to the presiding judge.

This ruling reflects the growing support for LGBTQ+ rights within Ukrainian society, particularly as the nation aligns itself with European values. A 2024 poll indicated that a significant 70% of Ukrainians believe LGBTQ+ citizens should be afforded equal rights.

While progress has been incremental, with civil partnership legislation still awaiting advancement in parliament, this court decision marks a significant stride forward, offering renewed hope for full equality and recognition for LGBTQ+ individuals and couples in Ukraine.
